As the owner of the website www.theflosedit.ee and its connected e-gallery and application art.theflosedit.ee (hereinafter collectively referred to as the “website”), my goal is to provide you with a seamless and inspiring art collecting experience. These Terms and Conditions govern the contractual relationship between me (brand: the flos edit., hereinafter the “Seller”) and any person placing an order or making a purchase through this website (hereinafter the “Buyer”).

By purchasing an artwork or commissioning custom art through this website, you agree to the following terms.

1. General Terms

1.1. By confirming your order on the website, you acknowledge that you have read, understood, and agreed to be bound by these Terms and Conditions. 1.2. Any matters not covered by these terms shall be governed by the legal acts and regulations in force in the Republic of Estonia.

2. Products and Pricing

2.1. All products displayed on my website are unique, original works of art or custom art commissions. Since these are handcrafted textured paintings, each piece is entirely one-of-a-kind. 2.2. All product prices are displayed in Euros (€). No VAT is added to the prices (or VAT is included, if you are a registered VAT payer). 2.3. Shipping and delivery costs may be added to the product price. These costs are calculated and clearly displayed in your shopping cart before you finalize the order.

3. Ordering and Payment Terms

3.1. To make a purchase, select the desired artwork and add it to your shopping cart. During checkout, please fill in all the required data fields and select your preferred shipping method. 3.2. Payment Method: Payments in my e-store are processed via invoice by direct bank transfer. Once you confirm your order, the system will send an automated order confirmation to your email address containing my bank account details. 3.3. Please complete the bank transfer within [3] business days, specifying your unique order number in the payment explanation field. If the payment is not received within this period, I reserve the right to cancel your order so the artwork can become available to other collectors. 3.4. The sales contract enters into force, and the fulfillment of the order (or preparation for shipping) begins the moment the total order amount has been successfully credited to my bank account.

4. Shipping and Delivery

4.1. I ship my artworks worldwide. Available delivery options include [Courier Service, Parcel Locker (if the dimensions of the artwork allow), or Personal Pickup]. 4.2. Because original paintings are delicate and valuable, I pack every artwork with extreme care and high-quality protective materials to ensure it arrives safely at your doorstep. 4.3. Ready-to-ship artworks are generally dispatched within [3–7] business days after the payment has cleared in my bank account. 4.4. For custom art commissions, the exact timeframes for creation, drying, and delivery will always be personally agreed upon with you before I begin working on the piece.

5. Right of Withdrawal and Returns

5.1. In accordance with consumer protection regulations, you have the right to withdraw from a purchase of a ready-made artwork within 14 days of receiving the item. 5.2. Important Exception: In accordance with the Law of Obligations Act, the 14-day right of withdrawal does not apply to custom art commissions which have been tailor-made to your specific requirements, colors, choices, or custom dimensions. 5.3. To be eligible for a return, the ready-made artwork must be completely undamaged, in its original pristine condition, and securely packed (preferably in its original packaging). The direct costs of returning the artwork shall be borne by the Buyer. 5.4. I will refund the amount received for the artwork as soon as possible, but no later than 14 days from the day the returned artwork arrives back to me safely and undamaged.

6. Claims and Copyrights

6.1. If you notice any defect or damage caused during transit upon receiving the artwork, please contact me immediately at info@theflosedit.ee so we can find the best possible solution. 6.2. All copyrights to the artworks remain strictly with the artist (brand: the flos edit.). Purchasing an artwork grants you ownership of the physical painting, but does not grant any rights for reproduction, copying, or commercial exploitation without my prior written consent.

7. Data Protection

7.1. Personal data submitted during the purchase process will only be used to process your order, issue the invoice, and arrange the delivery of the artwork. Detailed rules regarding your data can be found on my Privacy Policy page.
